PopOut Terms of Service

These Terms of Service ("Terms") govern your use of the PopOut mobile app and the popouttonight.com website (together, the "Service"), operated by PopOut ("we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What PopOut is (and isn't)

PopOut is a social venue-discovery app: you swipe to vote on nearby venues, see aggregated leaderboards of where people are headed, and connect with friends. Venue information comes from third-party sources and may be incomplete or out of date. PopOut does not operate, endorse, or inspect any venue, and is not responsible for anything that happens at one. Drink responsibly and follow the law — the legal drinking age where you are applies to you, not to the app.

2. Eligibility

  • You must be at least 18 years old. We collect your date of birth at sign-up and block accounts under the minimum age.
  • You must provide accurate information and keep your account secure. You are responsible for activity under your account.
  • One account per person; no accounts for or on behalf of someone else.

3. Your content and conduct

You retain ownership of content you submit (username, display name, profile photo, and similar), and grant us a worldwide, non-exclusive, royalty-free license to host and display it as needed to operate the Service. You agree not to:

  • post content that is unlawful, hateful, harassing, sexually explicit, or that impersonates another person;
  • abuse, scrape, reverse-engineer, or interfere with the Service, or circumvent rate limits or security measures (including App Check);
  • manipulate votes, leaderboards, or streaks through automation or coordinated inauthentic activity;
  • use another person's .edu email or otherwise misrepresent a school affiliation;
  • use the Service to plan or facilitate illegal activity.

We have zero tolerance for objectionable content and abusive users: we may remove content and suspend or terminate accounts at our discretion, with or without notice, for violations of these Terms.

Reporting and blocking. You can report any account from the ⋯ menu next to their name in the app, and you can block any account from the same menu. We review every report within 24 hours and remove the offending content or the account where these Terms have been broken. Blocking takes effect immediately and is mutual — blocked accounts cannot find you, send you a friend request, or see you on any list. Manage the accounts you've blocked under Profile → Settings → Blocked Accounts. Full instructions are on the support page.

4. Premium

PopOut Premium is an optional auto-renewing monthly subscription. It unlocks the leaderboards filtered by gender and age, and lets you browse any college's leaderboard. Everything else in PopOut — the nightly deck, the main leaderboard, friends, your Pop-Out List, events, and your own verified college's board — is free and stays free.

Price and billing. PopOut Premium is US$2.99 per month in the United States; in other countries the price is shown in your local currency on the purchase screen before you buy, and that screen is always the authoritative price. Payment is charged to your Apple Account when you confirm the purchase.

Automatic renewal. The subscription renews automatically for the same price each month, and continues until you cancel. Your Apple Account is charged for the renewal within 24 hours before the end of the current period.

How to cancel. You can cancel at any time in Settings → Apple Account → Subscriptions on your device, or from the "Manage Subscription" link on the PopOut purchase screen. Cancel at least 24 hours before the current period ends, or the next period will be charged. Cancelling stops future renewals; you keep premium access until the end of the period you have already paid for. Deleting the app does not cancel a subscription.

Refunds. Purchases are processed by Apple, so refunds are handled by Apple under the Apple Media Services Terms — we cannot issue them ourselves, and we never see your payment details. If Apple refunds a subscription, premium access ends.

Changes. Prices and included features may change. Changes apply prospectively, and a price increase never takes effect on an existing subscription without your consent, which Apple collects from you directly.

5. Our license to you

We grant you a personal, non-transferable, revocable license to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. All rights in the Service (other than your content) remain ours.

6. Termination

You may stop using the Service and request account deletion at any time (see the Privacy Policy). We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections 3 and 7–10 survive termination.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that venue data, wait signals, leaderboards, or availability will be accurate or uninterrupted.

8. Limitation of liability

To the maximum extent permitted by law, PopOut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of $50 or the amount you paid us in the twelve months before the claim.

9. Apple-specific terms

These Terms are between you and PopOut, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any product claims, third-party IP claims, or legal compliance relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Governing law & changes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. We may update these Terms; material changes will be reflected by the "Last updated" date above, and continued use after changes means you accept them.
